Florida’s Requirements for an Enforceable Postnuptial Agreement

Florida courts evaluate postnuptial agreements using standards drawn from Florida Statute Section 61.079, the state’s premarital agreement law. To be enforceable, a postnuptial agreement must be in writing and signed by both spouses. Beyond that formal requirement, courts apply two substantive standards when a spouse challenges an agreement.

First, execution must be voluntary. A court will look at whether either spouse signed under duress, without adequate time to consider the terms, or without access to independent counsel. Second, each spouse must have received fair and reasonable disclosure of the other’s assets and debts before signing. If that disclosure was incomplete or misleading, a court may decline to enforce the agreement. Even an agreement that satisfies both standards can be set aside if a court finds it was unconscionable, meaning so one-sided at the time of signing that enforcement would be fundamentally unfair.

A significant financial change can also prompt the conversation. What a Postnuptial Agreement Can & Cannot Cover

Under Florida law, a marital agreement can address a defined set of financial matters. Understanding the scope before drafting avoids provisions that won’t hold up.

Matters a postnuptial agreement can address:

• Spousal support (alimony) terms, including waivers or limitations

Matters outside the agreement’s reach:

• Child custody arrangements
• Child support obligations

Florida courts retain full authority over custody and support decisions. Because those determinations are governed by the child’s best interests at the time of the proceeding, they can’t be fixed in advance by a marital agreement. Any provision attempting to do so won’t be enforced.

Amending, Revoking, or Challenging a Postnuptial Agreement

Circumstances change, and a postnuptial agreement can be modified to reflect them. Spouses may amend or revoke an existing marital agreement at any time through a subsequent written agreement signed by both parties. The same disclosure and voluntariness requirements that applied to the original agreement apply to any amendment.

A spouse seeking to challenge an existing postnuptial agreement generally must demonstrate one of three things: that it wasn’t signed voluntarily, that the financial disclosure provided was inadequate, or that the terms were unconscionable when the agreement was executed.
