Robert Sparks Attorneys has filed a civil lawsuit against D.R. Horton – the nation’s largest residential homebuilder – over failures to properly screen a subcontractor who sexually assaulted a 4-year-old child when performing warranty repairs in the family’s home.
As reported by Fox 13, Robert Sparks and our legal team are representing the family of a 4-year-old girl who was sexually molested by Leonard Braudaway, a house painter and convicted sexual predator who had been hired by the homebuilder to finish repairs and interior painting in the family’s Tampa Bay-area home.
Braudaway pled guilty to criminal charges of ‘lewd or lascivious exhibition’ and violation of parole in January, and is currently serving a five-year prison sentence. Now our firm is helping the family seek justice and compensation for their damages, as well as needed reform to prevent similar incidents from happening to others.
Lawsuit Alleges D.R. Horton Failed to Conduct Background Check
As alleged in the lawsuit, D.R. Horton was negligent when it failed to conduct a background check on Braudaway, who at the time of the incident was on probation for prior similar offenses. Despite easily accessible information regarding Braudaway’s criminal history, D.R. Horton allowed him to enter homes and perform repairs.
As Attorney Robert Sparks tells Fox 13 News:
“D.R. Horton holds itself out as the largest homebuilder in the United States – not Florida, the United States. And we are not talking about an in-depth background check; we’re talking about a 20-second Google search where the subcontractor, which they sent into our clients’ home, has been a sexual predator – registered sexual predator – since 2016. Twenty seconds on Google and his record comes up all over the place.”
