WRONG-WAY DRIVING ACCIDENTS

Did Someone Else’s Negligent or Wrongful Actions Cause a Serious Injury?

A recent report released by the United States Department of Transportation’s National Highway Traffic Safety Administration (NHTSA) shows that law enforcement’s increased crackdown on driving under the influence (DUI) and changes towards seatbelt laws across the country have helped to drop the number of people killed in car crashes down by nearly 25 percent over the past 10 years. While these changes have helped to increase driver and passenger safety on the roads, they have had a minimal impact on the number of wrong-way accident deaths each year. The NHTSA reports that approximately 360 people are killed in these types of crashes every year – a small fraction of the 32,000 killed in car crashes in 2014, but these crashes are always caused by the wrong-way driver’s negligence or wrongdoing.

How Do These Types of Accidents Happen?

Federal agencies have closely tracked the causes of wrong-way driving accidents. In December of 2012, the National Transportation Safety Board (NTSB) released their Highway Special Investigation Report (PDF) to give the general public some details about some of their discoveries. A key piece of information included in their report showed that a significant number of these crashes occurred after the driver at fault entered an exit ramp. Even though investigators pointed towards confusing roadway design and poor signage as factors in several of these crashes, the drivers themselves often shouldered the blame themselves. Other key factors leading up to these crashes included:

  • Alcohol: DUIs were the most common factor in wring-way crashes according to the NTSB’s report. The data showed that 69 percent of at-fault drivers’ Blood Alcohol Content (BAC) was 0.08 percent of higher, and 59 percent of the at-fault drivers’ BAC was 0.15 percent or higher. As high as these numbers are, officials believe that the true figure is even greater, seeing as many of these crashes are missing information about the BAC level of the at-fault driver.
  • Age: Almost 15 percent of wrong-way driving crashes are caused by drivers older than 70 years old, while drivers in this age group are only involved in about 3 percent of right-way driving crashes. The NTSB report showed that only 51 drivers above the age of 70 were victims of wrong-way driving crashes, compared to the 233 drivers above the age of 70 who were the at-fault driver in these types of crashes.
  • Nights and Weekends: About one in every three wrong-way crashes occurred between midnight and 3 a.m., and 78 percent of all wrong-way crashes occurred at night. According to the NTSB report, approximately 57 percent of these crashes took place between Friday and Sunday.
