Although Florida Statute 732.703 offers protection for divorced spouses from their former spouses claiming an interest in their assets and insurance after death, it is always important to update your will and trust after a divorce. Most married couples will name their spouse as the personal representative of their estate or their trustee in a trust. However, section 732.703 does not expressly and automatically override these designations. Therefore, following a family law case, it is important to update and revise your will and trust to name a new person, other than your former spouse, as your estate’s personal representative and trustee of your trust.
